Abstract

The current study aimed to investigate the underlying logic for the infractional act committed by teenagers in conflict with the law. Two areas of knowledge were considered: Psychoanalysis and Law. We opted for a case study that analysed Jean Genet's text, titled The criminal child. For the treatment of the data, it was adopted the qualitative approach, the text being subjected to the method of content analysis proposed by Bardin. Five thematic categories were defined to extract from the text elements to elucidate the meaning of the infractional acts. It was found that the logic supporting the text is the claim for a "look" that gives some subjective place to his author. The weakening of the contemporany symbolic references – specially the paternal function – combined with a lack of social public policies to ensure a place for young people in the neoliberal society contribute to the teenagers' recurrence in the path of delinquency.
